This Privacy Policy for personal data (hereinafter, the “Privacy Policy”) applies to all information that the tour operator LLC “Sai-Khonash Travel” (hereinafter, the “Operator”), located at https://tuva-travel.com, may obtain from a User while the latter is using the website. The Policy governs the procedure for processing and using personal data of individuals who visit the Operator’s website at https://tuva-travel.com.

1. General Provisions

1.1. The purpose of this Privacy Policy is to protect the rights and freedoms of Users when their personal data are processed, including the right to privacy, personal and family confidentiality.

1.2. The Policy sets the obligations of the Website Administration for non-disclosure and for ensuring a confidentiality regime with respect to personal data supplied by the User when using the Operator’s website.

1.3. Personal data security means protection of personal data against unauthorised or accidental access, destruction, alteration, blocking, copying, provision, dissemination, as well as against other unlawful acts.

1.4. Processing and safeguarding of personal data are carried out in accordance with the Constitution of the Russian Federation, Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”, and other applicable Russian legal acts.

1.5. Principles of personal-data processing:

  • legality, fairness, and reasonableness;

  • restriction of processing to specific, lawful purposes;

  • prohibition of processing for purposes incompatible with the collection purposes;

  • processing in accordance with the stated purposes.

1.5. Terms used in this Policy:

  • Website – the site at https://tuva-travel.com. All exclusive rights to the Website and its elements (software, design, etc.) belong wholly to the Operator. Transfer of exclusive rights to the User is not the subject of this Policy.

  • Website Administration – authorised employees acting on behalf of LLC “Sai-Khonash Travel” who organise and/or carry out personal-data processing and determine the purposes, scope, and actions (operations) performed with personal data.

  • Personal data – any information relating to an identified or identifiable natural person provided voluntarily by the User while using the Website.

  • Processing of personal data – any operation or set of operations performed with or without automation, including collection, recording, systematisation, accumulation, storage, updating, retrieval, use, transfer (distribution, provision, access), depersonalisation, blocking, deletion, or destruction.

  • Personal-data operator – a state or municipal body, legal entity, or individual that organises and/or carries out the processing of personal data, and determines the purposes, scope, and actions performed with the data.

  • User – an individual who has access to and uses the Website via the Internet.

  • Confidentiality of personal data – a mandatory requirement for the Operator or any other person having access to personal data not to disseminate them without the subject’s consent or other legal ground.

1.6. Use of the Website signifies the User’s full acquaintance with and consent to this Privacy Policy.

1.7. If the User disagrees with the terms of the Policy, he/she must stop using the Website.

1.8. The Website Administration does not verify the accuracy of personal data provided by the User; the User is solely responsible for incorrect or incomplete data.

2. Subject of the Privacy Policy

2.1. Personal data mean information required by the Website Administration in connection with civil-law or other relations concerning a specific data subject.

2.2. Personal data authorised for processing under this Policy include:

  • surname, first name, patronymic (as in Russian passport);

  • passport series and number;

  • passport expiry date;

  • date of birth;

  • contact telephone number;

  • e-mail address;

  • registered and actual address;

  • any other obligatory information relating to an identified or identifiable data subject for the purposes of this Policy.

2.3. The data listed in clause 2.2 constitute confidential information. The Website Administration shall keep such data confidential and shall not disclose them without the User’s consent or other legal ground. Consent is deemed given through the use of the Website.

2.4. By submitting personal data via the Website, the User gives a voluntary and open-ended consent to their processing on the terms set forth herein. Consent is given freely, at will, and in the User’s interest in accordance with paragraph 1 of Article 9 of Federal Law No. 152-FZ.

2.5. If the User disagrees with the Policy, he/she must cease using the Website.

2.6. Unconditional acceptance of this Policy is commencement of Website use by the User.

2.7. The Operator may update the Policy as necessary; Users are advised to review it periodically. Continued use of the Website after changes signifies acceptance of the updated Policy.

3. Procedure for Processing Personal Data

3.1. The processing period is determined by the duration of contractual relations with the User and the applicable limitation period.

3.2. Personal data may be transferred to authorised state bodies of the Russian Federation only on grounds and in the manner prescribed by law.

3.3. The Website Administration adopts necessary organisational and technical measures to protect personal data from unlawful actions of third parties.

3.4. To ensure information security, the Operator uses:

  • firewalls and anti-virus systems;

  • standard industry security measures.

Cookies. The Operator uses cookies—small text files stored on the User’s device to tailor the interface to the User’s preferences. Most browsers allow refusal or deletion of cookies.

3.5. Personal data remain confidential unless they are made public by the User.

3.6. The Operator stores personal data only on servers located within the Russian Federation.

3.7. The Operator may transfer personal data without the User’s consent to:

  • state bodies (including investigative authorities) upon a motivated request;

  • other cases expressly provided by Russian law.

3.8. The Operator may transfer personal data to third parties not mentioned in clause 3.7 where:

  • the User has consented;

  • the transfer occurs within a sale or other business transfer (in whole or part) to a successor subject to this Policy.

3.9. Personal data are obtained solely to provide services to the User and are not used for other purposes or disclosed to others.

4. Obligations of the Parties

4.1. The User shall:

4.1.1. Provide accurate and complete personal data (including data of third parties specified in an order).
4.1.2. Obtain written consent from such third parties for processing their personal data.
4.1.3. Update personal data in case of changes.
4.1.4. Monitor changes to this Policy by reviewing its current version.

4.2. The Website Administration shall:

4.2.1. Use personal data solely for the purposes set out in Section 2.
4.2.2. Keep personal data confidential; not sell, exchange, publish, or otherwise disclose them.
4.2.3. Take precautions customary in business practice to protect personal data.
4.2.4. Block personal data of a User upon his/her request or that of an authorised body during verification of inaccurate data or unlawful actions.

5. Use of Personal Data

The Operator undertakes to use Personal Data in accordance with Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”, other Russian legal acts, and this Privacy Policy.

5. Liability of the Parties

5.1. The Website Administration bears liability in accordance with Russian law.

5.2. The Website Administration is not liable for loss or disclosure of confidential information if such information:
5.2.1. Became public before its loss or disclosure;
5.2.2. Was received from a third party before it was obtained by the Administration;
5.2.3. Was disclosed with the User’s consent.

6. Dispute Resolution

6.1. All disputes arising from this Policy shall be resolved in accordance with Russian law at the Operator’s place of registration. Before filing suit, the User must submit a written claim to the Operator.

6.2. Claims are reviewed within thirty calendar days of receipt.

6.3. If a dispute is not resolved out of court, either party may apply to a court of competent jurisdiction in the Russian Federation.

6.4. Russian law applies to this Policy and to relations between the User and the Website Administration.

7. Additional Provisions

7.1. The Operator may amend this Policy (in whole or part) unilaterally at any time without prior agreement with the User.

7.2. The new Policy enters into force upon posting on the Website unless otherwise specified therein.

7.3. Should any provision of the Policy be deemed invalid or unenforceable, the remaining provisions shall remain in force.
